Apple Lawsuit
Birmingham, Alabama resident Jessica Alena Smith has filed documents in her local US district court, charging Apple with breach of express and implied warranty and with unjust enrichment – all down to the failure of the hardware manufacturer’s new iPhone 3G to stick to a particular network or band for the duration of a phonecall, even when in a 3G-rich environment.
The suit requests that if successful, Apple should repair or replace all defective devices and pay unspecified damages. Coming just days after Apple’s OS 2.0.2 bugfix iPhone update – which fails to specify what is being fixed – it seems unlikely that Jessica Alena Smith will succeed.
At the very least, however, Apple should be ordered to divulge details and contents of all previous and future bugfixes.
